Associations and foundations
The Franco Notary Office handles the incorporation of foundations and associations.
These are collective entities established by law to pursue altruistic, nonprofit objectives. In foundations, the endowment—the assets set aside for the entity’s stated purpose—plays a central role. They must be established by a notarial deed, which serves to obtain recognition of legal personality and the resulting effect of full financial autonomy.
Associations fall into two categories: recognized associations, which are also legal entities, and unrecognized associations, which do not have that status.
Third-sector organizations
The entire nonprofit sector has undergone significant reforms, culminating in the enactment of the Third Sector Code.
Third-sector organizations, regardless of their legal status, are characterized by their non-profit nature and their pursuit of civic, solidarity-based, and socially beneficial objectives through the performance of activities in the public interest.
Studio Notaio Franco has always provided consulting services regarding both amendments to the articles of association of existing entities and the incorporation of new entities, with a particular focus on the registration process with the Single National Register of the Third Sector, whether or not the aim is to obtain legal personality.
